Sorry BJ, I hate to disagree with anyone, but I am only stating what questions were asked of me when I filed my grievance with CONECA. Just because Ken P is a board member for CONECA, it does not mean a CONECA grievance can be filed against him for coins attributed outside of CONECA. The board will not have any jurisdiction over that. He MUST be doing work under the scope of CONECA (IE attributions) before the grievance can be filed.
CONECA has no control over his Variety Coin Register, his articles for periodicals or anything else he does UNLESS he is doing it for CONECA.
Even if you are a member of CONECA, this does not entitle you to file grievances against a board member unless it is against the bylaws or articles of CONECA.
If someone sent him a coin to look at and photograph for an article in Coinworld, and he still has not returned it, what does that have to do with CONECA? On the other hand, if they sent him that same coin for addition to the CONECA Master listing, then they surely do have the right to file the grievance.
(Do you see where I am going with this?)
I have been through the process. I know first hand how it will probably go. If course, you all may try to file the grievance under whatever circumstances you find yourself in. I am just letting you know that the grievance board's powers are limited to CONECA business, and CONECA business only. We already know that KEN is prepared to do nothing...and it seems he had even dared me to file my grievance. The board gave him SIX WEEKS to return 3 coins of mine, and he took all but 2 days of it to get them back to me. How long does it take to put coins in an envelope and mail them out?? I was not too happy with the way the grievance process went, but I did get my coins back. No one should have to go through this to get their property returned, and as all you know by now...even though this has been a hot topic, and Ken was instructed to return all coins by the CONECA president, he has still not done so. He is pretty much ignoring any one or anything having to do with honesty and integrity in the hobby. It is a sad state of affairs that affects OUR hobby and other coin collectors. The black eye we have received from this sort of treatment from an 'expert' in the hobby, may never heal.

I haven't had any dealings of this type, with KP, and maybe it is good. I'm a sore loser, when it comes to things that; while they may be a paltry sum, o to some, it is a great deal of money to others. My view of this whole scenario, is that CONECA is going to lose a sizable number of it's members, if this continues as is.

Bob - If it is a CONECA member, he or she has a right to fill a grievence against another CONECA member. Having just read the by-laws, there is no stipulation concerning what grounds the grievence can be made for. As a matter of fact, it does not even stipulate that the person filing the grievemce must be a CONECA member. This is the section pertaining to the by-laws.
"Grievance Committee consisting of a minimum of three members of the club, one of whom shall be a Board member who chairs the committee, shall be appointed by the President. All grievances against a member of the club shall be submitted to and investigated by this committee. The committee shall do its best to resolve the grievance; however, should the committee be unable to do so, the Chairman of the Grievance Committee shall brief the Board Secretary on the findings and recommendations of the Grievance Committee. The matter will then be presented to the Board for a vote upon resolution of the situation. The decision of the Board is final; failure to comply with the decision of the Board could result in disciplinary action by the Board."
Unless there is a hidden clause, which would be contrary to any type of by-laws, it is fairly cut and dry; a grievence can be made by any person. Another section that is pertainent is this section.
"Conduct by any member, which upon consideration by the Board, shall be deemed detrimental to the welfare of the club or the hobby as a whole, or contrary to the avowed aims of the club, shall be subject to penalties ranging from reprimand to expulsion at the discretion of the Board by majority vote. Any Officer, whether elected or appointed, who has been removed from office, who has been requested to resign his/her office by the Board as a result of such disciplinary action, or who has resigned from the club and has later been reinstated, shall not be eligible for election or appointment to any office in the club unless reinstated to eligibility by further action of the Board."
These two statements, when combined, cover conduct detrimental to the numismatic community, both inside and outside the confins of CONECA. If you were lead to believe that grievences could be only filed concerning CONECA business, then that was in error or mis-leading information.
I do encourage anyone that does have a valid grievence against any member of CONECA for detrimental behavior to the hobby, no matter in what area, to file it and file it as soon as possible.

I read the same thing you did BJ. The questions asked of me before I filed the grievance led me to believe differently than you. I will not drag this out based on interpretation as my goal and yours is the same. I have been trying to get folks to file a grievance from the very beginning, but so far the only one I know of has been myself. This also includes you and your coin.
My whole point is that you should be prepared for the same questions I was asked. The grievance board has to identify the merits of the grievance and whether or not they can address the issues at had. Should they have to take the actions they address for non compliance, my view is that there will be some reason for not doing so. We will see. Ultimately, nothing happens unless someone takes the steps of filing the grievance. All this talk and advice is absolutely useless unless people take advantage of the process. You will never know until you try.

I can see questions pertaining to the merit of a grievance being asked and Bob, I believe you 100% that you were asked these questions. We just can not have ever minor little occurance being brought before a board. All I am saying is that it should not make any difference if you are a member of CONECA or if it the coins sent were through the CONECA attribution system. Mr. Potter sits on the CONECA board and should be held responsible for all his actions that are detrimental to this hobby. If he is so inclined to tarnish his reputation, let him have at it, but do not drag the organization that you represent along with it.
Yes, I do have 3 state quarters with doubled dies, two of which are discovery pieces, with Mr. Potter and it has been well over a year that they are in his possession. CONECA's president, Mike Diamond is also aware of this fact and now everyone who does read this, will know my situation. For reasons that I will not say at this point, I have forestalled making a grievance, however, I may in the future file one.
This is a regretible incident which may have started with a few innocent mistakes or occurances, but now has turned into a hydra with the reluctance of Mr. Potter to put things back into order.
I am not to sure what is coming next and as I stated before, if you feel that you do have a grievance concerning Mr. Potter's handling of your coins, no matter which program you submitted them through, file it.

PS -Just received an email from Mike Diamond and there is a correction to be made. It is the CONECA board's request that any grievance filed must be from a CONECA member.
