A long time ago, in Sept. of 2003 , I posted a topic in this thread on a design for the 2009 cent, well, I'm in contact with the mint on the design that they are going to use, the cabin design done by one of their artist. It's to close to my original one, there looking for proof that I did indeed do this design before any other pictures of designs for the cent were posted anywhere on the web, or anywhere else for that matter. I know a few of you out there remember, and you can research this by looking for the thread, ( What do you folks think of this...........) I've already copied the post to send to them as evidince that I,m telling the truth on creating the design before their artist did. The first reply I sent them, I told them it was done in 2005, that's my current picture, I forgot about my first photo server going south with the original, original picture and had to redo it. 2003 was the first one shown here, any kind of help will be appreciated, Thanks,.............Brian B. Hi Brian, It has been a while since you posted! Welcome back. I have not been a member that lomng, but if I had seen that photo, I would have "lifted" it, and kept it in my files, as part of the sight info, etc that comes my way, for learning, etc. I would be very happy to provide it , if I had it here. I'm sure it can be re--located, and provided you for your needs. It would be a shame to see some other "artist" benefit, from your original idea.

Hi Dick, and thanks for the thought, but it's not the picture I'm needing, I know that one is long gone, just looking for some of the members that remember to just post a testimony of sorts in this thread so I have something of witnesses that remember that picture, don't know if it will help, but something on a personal nature can't hurt.................B.

Brian, I don't know if it will help, but I'll put out a call to all members, and those in particular, who have been here "forever". that one of us needs some help. Read Brians, post, and see if YOU remember his story, about his design for the "lowly cent" reverse. I think the idea is good, and the need is just. Thank you ALL for any help remembering , "way back then".

Hi, I have a small amount of experience with images and rights associated with them, since I worked in the publishing industry for years. I will preface by saying I don't offer legal advice. That said, I believe you'll basically need to prove that your image in public view precedes any work done by the mint. Then you would need to establish your design idea was in fact used by the artist for that cent design. Proving use is very hard to do, and court cases have been hit/miss on this one point--of those I remember.

While I see the perspective angle of your design is very similar to the mint design, did you work from your own, original photograph--or from an image already in public domain? If your rendition of the cabin came from a publicly available image, then the mint designer could have just as easily used the same image for their inspiration. There I think you may have less of a case, since both of you worked from the same source--and there might be 3rd-party rights to that photo. However, if the source photo for your design was taken by you, that might bolster your assertion, provided the chronology of your design can be established.

Those are some admittedly incomplete thoughts--simply from working with copyright issues in publishing and marketing over the years. I like your design better-- E Pluribus Unum is odd under the cabin; the larger date is perfect there--good luck!

Thanks Dick, Robert, and Kurt, Robert, just by saying you remembered is enough, Kurt, the picture of the penny I took using my digital camera, the picture of the cabin I lifted off the web after doing a image search, then I did my magic on photoshop, the cabin was a black and white, and I added color to it and cut and pasted it to the penny image. Robert, unless someone lifed the 2003 picture I did, it's gone when the server I was using up anchor and sailed into the twilight zone, I now kick myself in the a$$ for not saving it.
